    Default Sick Days in AL

    Hi - I work in Alabama and would like to know what laws apply to being allowed sick days... Our handbook says we get 5 per yer, but an employee tried to call in sick last night and was told she HAD to come in. Personally I think we are discriminated against because we work the overnight shift and nobody wants to fill in for us. Dayside people are not given any hassle when they call off sick. Can the company legally deny us sick days?

    Can the company legally deny us sick days? Yes. No employer in any State is obligated to provide sick days, whether paid or unpaid, to begin with (unless the illness constitutes a "serious medical condition" and the Family and Medical Leave Act applies - which it wouldn't if we're just talking an employee calling in sick for a night or two with the flu, a cold, etc.)

    The employer is not engaging in any form of prohibited discrimination if they find they have to be tougher on attendance and granting sick days to the night shift than they are to the day shift.
