I work for a small non profit company. My immediate supervisor has had it out for me lately and wrote a note in my personnel file which I stumbled across saying that I had been abusing company time and supplies. I do admit to using the company computer and phone for personal use but as she and every other employee including the executive manager do likewise, I feel discriminated against. My first question is whether as an employee I have a right to see things that go into my personnel file. My second is whether her actions toward me, singling me out for time monitoring and general harassment count as discrimination. Thanks |

Under California law, you are entitled to see your file on request and to have a copy of anything in it that you have signed. However, they have no legal obligation to show you everything they put in your file before they put it there.
Unless you are being singled out BECAUSE OF your race, religion, national origin and so on, no, this is not illegal discrimination. What you describe does not meet the legal definition of a hostile work environment. |
