Default Drivers' Overtime

What are the laws on overtime pay? After 40 hours. Do you have to pay driving time?

Default Overtime Pay; Driving Time

Overtime is paid to non-exempt employees for hours worked in excess of 40 in any given workweek. A workweek is a fixed and regularly recurring period of 168 hours or seven consecutive 24-hour periods. It may begin on any day and at any hour of the day, and different employees or workgroups may have different workweeks. You are not permitted to average your hours over two or more weeks.

Depending upon the situation, drive time may be considered "hours worked" and may be subject to overtime pay. If an employee electrs to drive his/her vehicle rather than taking offered public transportation, an employer may elect to count as hours worked either the time spent driving or the time which would have been counted as hours worked ifr the employee had used public transportation. If the employee is not offered public transportation and is required to drive, regardless of when it occurs, it must be considered hours worked. If the time falls outside the normal workweek of 40 hours, then it is subject to overtime pay.
