My boyfriend was orderde to pay chils support last month. He has been paying and did get a lawyer, but still can not see his son because the mother says he has to go into counseling for ADD. My b/f and I have a 4 year old son together and she has been playing games since her son was born. I wanted to know what we have to do to get visitation and or custody. She is unfit in the matter that she uses drugs, her child has been sexually abused, she moves her three children from place to place until she finds some guy to take care of her. They are in unstable conditions and I would much rather have his son with us. I need to know what we can do to resolve this. He doesn't even know where his son goes to school. And, her b/f got upset when he called to check on his son. It seems like no matter what we do, there are obstacles. We live in Illinois

First, you need to get a copy of the custody order to find out what his rights are. I am assuming it is joint custody with visitation. If you try to exercise reasonable rights and are not able to, document it and if possible have the police come out and show them the order. If still no response, go to the court that rendered the custody ruling and ask that the mother be put in contempt of court and request modification of the custody arrangement. For the part that requres going to court, you can represent yourself but it is advised to hire an attorney if you can.
