I am 22 years old and have a 3 year old daughter. I was with her "daddy" for 4 years. But,he is not her bio father,and he knew that I was pregnant with her when we got together.Him and I was best friends since I was 15 and was on and off again. But anyway,her bio father has nothing to do with her. And if you show her a picture of her "daddy" she can tell you all about him. He bought 'us' a house in 2003. But it is in his name. And I really don't want it. He claimed me and my daughter on his income taxes since she has been here,He claimed her as his daughter and this past year on the papers it said (daughter)right beside her name.Because he didn't sign the birth certificate.No one did where it says "Father's Name". But also on the hospitial baby annocenment page as the parents it has both of our names.And in the state of Georgia the "Common law Marriage" is no longer,But he filed us common law married in 2003. So I'm not sure if i'm married or not. And could I get him for child support even if he is not the bio father with the best interest of the child law?

Hi, I am really not an expert, but I think if the real father gave up his rights, and the stepfather sign a fourm making him the legal father, then you would be able to file child support. But to be sure check out these sites

If the non-bio Dad is listed as the father, you can likely file to get child support, but is that wise. This man has been very kind to take on a responsibility that he did not have to. Before you do something like file for child support, you need to talk to him to see if the two of you can come to an arrangement about child support. If you file for child support, it may end his presence in your child's life if he is not agreeable to that and he will go thru the process to establish that he is not the father and there is a chance that the court will let him off the hook. You should speak with him first because if you file for child support and it is interpreted as a greedy, selfish act, your child could lose a parent. And if he elects to be the parent, he could petition to get custody of the child himself. Tread very carefully. You may not end up where you think you might if you do this the wrong way.
