Default How to get parentail rights revoked

First, I would like to know how is it that the people that owe child-support are able to go with out paying for so long. I am dealing with Ohio state in this matter. My son is 11, i have raised him with my husband of 8 years . . No problems doing so, however, 4 years ago, Iwent after his father for child-support. He was visiting him and trying to establish a relationship with him. With coaxing from his fathers parents, i went after him for child support. He was paying for about 6 months. Then , nothing. He has been served and in court many times. He now owes over $5000.00. Everytime he goes into court, they slap him on the wrist and say pay or else go to jail. So , he makes a $20.00 payment, and they throw out the contempt order. Then the cycle continues. He is also living with a married woman who has 4 kids, one of the kids is not his, but was given his last name., good for them. he works under the table, and has a daughter from his ex-wife. I was in the hospital 2 years ago for pre-term labor of my twins. My son was visiting his father and grandparetnts at the time, but had to stay a couple extra weeks while they were trying to stop the labor. In that time, his father physicaly ,emotionaly, and verbaly hurt my son. Also, his father has had no contact what so ever since that summer. My son, is now in therepy because of him and very depressed. He has not only stated to his thereipst and myself, but also a letter to his father that he does not want anything to do with him ever. He has felt like this for a long time. After all my rambling.. i need to know if and how i can have him sign off parental rights. I thought since he shows no interest in my son and vise-versa and owes so much in child support that it would not be that hard to do so. I have no clue how to get started, where to go, how to go about doing it. I dont want a mess, i just want him to sign off. He can keep his money and support someone elses kids for all i care. I just need to get him legally out of my son life.

In order to terminate parental rights you must file a motion in court. However, terminating parental rights is very difficult.

Yes. Go to family court or probate court.

Default Formally file a petition to terminate his parental rights

You will have to file a petition for termination of parental rights. The former husband will have to agree to this and even if he does, the court will likely hold a hearing to hear all parties.

We were never married, does that make a diffrence? For the first 6-7 years he had nothing really to do with him. no contact, nothing.

Ok, .. If I have a will and it states that if i die, my son is to be cared for someone other than the biological father, in ohio state, would that prevent him from coming and being able to take my son, or anyone else that was not named guardian for him?

I don't know Ohio laws but I am having the same problems you are. I have a 12 year old that the father was not in his life for six years. Now my child has been suffering for 3 years now since he took it to court. I know it is very hard if the other parent will not sign off, you have to file at the court house and go in front of a judge and prove why that would be best for your child. I understand what you are going through and I hope everything works out for your sons sake, because mine my son is now in a very high depression state since father came into his life again. God bless you!
