Overtime is paid to non-exempt employees for hours worked in excess of 40 in any given workweek. A workweek is a fixed and regularly recurring period of 168 hours or seven consecutive 24-hour periods. It may begin on any day and at any hour of the day, and different employees or workgroups may have different workweeks. You are not permitted to average your hours over two or more weeks.

FLSA does not require that overtime be paid for hours worked in excess of eight hours per day or on weekends or holidays. However, states are permitted to provide workers greater overtime protections than those offered by FLSA. |
