    Default breast feeding breaks California

my sister is young, she just started back to work (retail) from her maternity leave. and she pumps for breast feeding, she works in retail and her boss if giving her a hard time when she needs to pump. she said she pumps right before her shift starts, on her break, but sometimes is full before the end of her shift. her boss has been harsh with her about asking to pump and tells her she needs to do it on her break (which according to her word she does.) what are the rules that go along breastfeeding and breaks?

There isn't an absolute number of breaks required and breaks over 20 minutes need not be paid. I am wondering how long her shifts are that before, during break, and after work are not enough? http://www.dir.ca.gov/dlse/FAQ_RestPeriods.htm

CA Labor Code 1030 should answer your question pretty easily.

1030. Every employer, including the state and any political
subdivision, shall provide a reasonable amount of break time to
accommodate an employee desiring to express breast milk for the
employee's infant child. The break time shall, if possible, run
concurrently with any break time already provided to the employee.
Break time for an employee that does not run concurrently with the
rest time authorized for the employee by the applicable wage order of
the Industrial Welfare Commission shall be unpaid.

The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
