    Default Arizona Layoff - <50 employees - what is correct length of notice Arizona

    I worked for a company in Arizona. They have less than 50 employees. They verbally notified us on a Friday morning that they were going to start laying off people. They laid off 5 of us the next Monday afternoon.

    My question is: Is it legal that they told us Friday of layoffs, off the weekend, then lay us off on Monday?
    Also: We didn't get any severance (except for any saved vacation), is this legal too?

    They really didn't need to give you any notice before laying you off (never if less than 50 employees) & severance isn't required. There isn't anything illegal here unless you have a binding employment contract or CBA to the contrary.

    You need to look for other employment & file for unemployment ins.

    Unless WARN applied, which it did not due to the size of the company, they didn't have to give you any notice at all. They could have told you as you entered the building, "Sorry, but you've been laid off as of now, turn around and go home" and that would have been legal.

    There are some very valid reasons NOT to give a whole lot of notice, or any, to employees who are under the threat of layoff. I once ended up having to clean up the mess after an angry employee, given fifteen minutes to collect her personal things, managed to do $2000 worth of damage to equipment, deleted several key files, and cancel all the travel reservations for all the senior managers for the rest of the calendar year (it was October). If she could do that in 15 minutes, how much damage do you think an employee could do in five days? Or two weeks? Or whatever span of time you were thinking?

    Severance is not required by law in Arizona (or 46 other states).
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.

    That is a good point as to why employers don't give much & in some cases any notice of terminating/laying off employees.
