    Default Can the clerk determine if you have to pay fees? Alaska Federal

    I went to file my Bankruptcy and 2 Adversarial Proceedings. I included a request for fee waiver and the clerk told me I have to come up with $700 before he will accept the complaint. Can he do this? He said that the judge will waive the bankruptcy fee but not the adversarial fee. Can I file another form to have these fees waived?

    The court clerk generally knows the rules. You can contact a bankruptcy attorney in your area & ask them your question. They will probably answer without charging you anything. However; if they require the fee before filing the complaint, you normally have to pay it.

    They sometimes waive the bankruptcy petition filing fee but some states do require an adversarial proceeding filing fee that isn't waived.
