if ex doesn't pay child support, does he get to see babies?

I live in Everett, Washington and I am military, but my husband asked for a divorce after four months of having twins, I also have a 3 yr old by him. After he left, he immidiately moved in with his new girlfriend and we aren't even divorced yet. The papers are already filed, but I still don't recieve any payments from him. Does he automatically get off of paying child support for three months? cause that wouldn't be fair to me, I am paying all of the living expenses and bills. This doesn't seem right. Do I have the right to refuse him visitation? also is it legal for him to be living with this girl when we're still married? what do I do?

The father has a right to see his children, unles the court says otherwise. If the court orders child support payments, he must pay or he may be held in contempt of court. I do not believe it is illegal for him to live with a girlfriend while he is married, although it can make him look bad in court.

so when do i start recieving payments? do i have to wait til after we're divorced, or after the papers have been filed?

The court can order child support payments before or after the divorce.

I hope you are being represented by base JAG. If so, go see them and seek interim orders for child support to be issued as well as interim orders giving you primary physical custody of the children and him having supervised visitation because he is living with a woman and you do not want the children exposed to this since it may confuse them more than they already are during this interim phase. Also, ask to not have to provide him any support since he is not providing any child support and you need the money to care for the children.
