My sister is in a simular situation. Husband came illegal, had child, in the middle of divorce. You need to go to family court along with notations of police reports, list of threats etc and file for temporary custody. If your child is in school, make sure the school has on record for NO ONE to pick up this child without your permission. Have a record of temporary custody on file. You ARE at high risk.

You need to file an emergency petition where you reside now for you to obtain sole custody of your daughter with no visitation or supervised visitation with the father. The reason would be that the father is a flight risk due to his immigration status. It is best to obtain legal counsel for this. If you are poor, contact Legal Services or Legal Aid for assistance. Sometimes, local bar associations have attorneys who take cases pro bono.
