Hello-
I recently quit a job as a cook, and when I went to collect my check I found out I was salaried rather than hourly (paid by shift @ 8 hours/shift). The shifts I worked ranged from 6.5 to 11.5 hours. First, is this legal? Second how should I go about collecting what I'm owed from the restaurant? (I worked 11 shifts, and was only paid for 7). Thanks in advance for your time- Dan Brown |

A cook is a non-exempt position, meaning you should be paid for every hour your clocked in and paid overtime for any hours worked over 40 in their scheduled work week.

Thank you for the guidance on resources, and the answer to my question regarding the legitimacy (or lack thereof) of salary for a cooking position. I'm going to follow up with the employer first and see if they're willing to resolve this. Is there anyone I can inform of their illegal salary practice? No one should be getting paid like this, and I hate to see it go unreported.
