I currently reside in WV. My son lives with his father, by only verbal agreement. My ex-boyfriend, (son's father) was very abusive both mentally and physically.. I did agree to allow my son to stay with his dad to avoid the threats and fighting that I would deal with every day. Well his father recently got married and my son started school, and I just don't agree with the way there taking care of my child. He's late going to bed on school nights, and has to get up very early in morning to catch the bus, that don't bath him all the time, they dress him terribly, when I buy him very nice clothes and shoes. They won't make him wear them. They (themselves) do things around the kids, that I don't approve of.. If I take the chance and take him to court for full custody and put myself in a position for possible danger, will i get full custody of my son....

Whenever you go to court, anything can happen. There are no guarantees. I suggest that you consult with an attorney who specializes in family law.

IF your son is with the father by verbal agreement, then you should ask the father to return the son back to your physical custody. If that does not work, then you can go to the court and request that they order that primary physical custody of the child be returned to you.----Anything can happen in court. The father is married and that is sometimes looked upon favorably. The standard is the best interest of the child. I do not know enough to be able to really say how it would turn out because there are pros and cons on both sides. You should consult local counsel.

I lost both my girls due to the fact he had remarried BUT I am returning to court because he was abusive to his current wife start taping conversations a recorder costs 40.00 bucks at radio shack and they have a gizmo that attaches to the phone so you can record anywhere, become best friends with that new wife cause believe me they need saomeone who knows there situation to confide in I've been bestfriends (hating it) with her for 3 long but vfery informative years.
