    Default Auto Accident New York

    We are currently being represented by a lawyer who has filed a complaint against the drunk driver who caused the accident and caused bodiliy injury....The defendant was drinking at a local bar prior to the accident. My question is should we be filing a dram shop case as well or at least investigate now? The lawyer feels to go after the defendant should suffice...

    Generally if you have an attorney, it's always best to follow your attorney's advice & ask him/her any questions you might have.

    The general rule is sue everyone and let them all sort it out. It might be negligent to NOT sue the bar that served the guy after he was visibly drunk or if they knew they served him x number drinks in y amount of time which would likely render him drunk.

    Per my reference, most drunk driving accident victims do not file dram shop cases against the drinking establishment - mainly due to the generally small amount of recovery received. You can re-discuss it with your lawyer though.

    As a normal people have lack of information and knowledge on legal issues especially in accident cases, so it is quite better to follow your attorney who is liable to show you a positive way.
