My wife was driving in stop-and-go traffic last evening. Car in front of my wife stopped and so did my wife. The person behind my wife didn't stop in time and hit my wife and pushed her into the car in front. The police report is not available yet but the statements taken by police at the scene collaborate these facts and we have no reason to think the report will say otherwise. The only person cited was the one that hit my wife from behind.
My wife is 8 months pregnant. She was visibly shaken by the event and worried that something may have happened to the baby. We went to the hospital last evening and again this morning as a follow-up. Baby and momma are fine other than a stiff neck & back and the emotional distress around the event. I'm guessing $3-4k in damages to our vehicle with no other property damage.
What is the best course of action? Do we file a claim with our insurance company or that of the person 'at fault'? I know how it goes if we file directly with the other person's insurance company, but how does it work if we file with ours? Will it raise our rates because we "filed a claim"? Will our insurance company negotiate for the physical/emotional injuries or are they only interested in the property?
What are the pros and cons of each course of action?
