    Default Can a 1099 receive unemployment benefits in TX Texas

    I was a (W2) employee for a company for 10 yrs and was recently laid off due to work force reduction. Within a week I found another job as a 1099 employee, but I was let go 3 weeks later due to the company not getting a contract and therefore having a reduced work load.
    Can I still apply for unemploymeny benefits ???

    You might be eligible. The base period that a new claim would look at is the calendar year 2008. All you can do is file and find out.

    Was the latest job a legitimate independent contractor situation? In this job, what type of work did you do (not your job title) and what type of business did you do it for (not the name of the company)?

    I did IT work, and worked in the company office using their equipment (laptops), worked from 8:00 to 5:00 and was paid every 2 weeks.
    Actually the work I did was for my old company, which is now contracting out the work.

    I would claim the earnings when you file. It's not at all clear that treating you as an independent contractor was legal.
