Hi folks! Great to find a helpful site such as this when you need it!
After shopping (no gas) my wife (1) was leaving the area after parking near the far right side of the Post Exchange Shoppett/Gas Station parking lot. While exiting the parking lot she stopped to yield to a car (2) that was already in the process of backing out of their parking spot. Meanwhile to my wife's direct right, a parked truck (3) started to back up headed for the wife's car passenger side doors (Camry). The wife honked the horn in warning but was hit anyway.
She was at a complete stop when hit (I can prove it with pictures).
Military Police (MP) were called. Before their arrival my wife moved from the accident hit site to the open parking spot vacated by the car she yielded to (bad move on her part).
MP's sited her for "Failure to Control Speed to Avoid an Accident" and said that she was at fault????
MORE INFO: Wife is from Korea and doesn't read or write English. I don't have Guy #3's statement so I don't know what he told the MP's. Car #2 didn't hang around and no witness statements were taken.
ACCIDENT REPORT states that the wife left the gas pumps (remember, she didn't get gas) at a speed too high for the conditions when contact was made with vehicle #3. Guy #3 told the MP's that he checked all of his mirrors before backing.
I believe that the MP investigator thinks the wife basically sideswiped the back of the truck as she passed by. SHE WAS STATIONARY. My pictures and measurements prove it beyond a doubt. Now what?
How is the wife at fault?
