I work in the state of NE. I currently have an employee that was just discovered secretly recording conversations of other employee's as well as his superiors. He has a total lack of respect for anyone and feels he is above everyone. This employee is not liked by numerous people now that they know he is doing this. He tends to have many confrontations with others. The problem is that most employees feel that they can not say anything to him because he might use that against them. He has created a false sense of power amoungst his peers.
I know that NE is a one party consist state, and I have spoken with HR and they claim that there is pretty much nothing we can do. There has to be something illegal about this violation of privacy. Please help. |

Does the Company allow recording devices on the property ? Whether it's a one party state or not you are not required to let him do it.

The company has no current policy in place for recording devices. What makes it worse is this is college campus where laptop's with microphones are permitted all over campus.

The fact that he has not violated any laws does not mean that there is nothing that can be done. If the employer chooses to do something they can, regardless of whether Nebraska is a one-party state or a two-party state.
If the employer chooses, they can tell this fellow that he is to immediately cease recording conversations while on company premises and that he will be fired if he fails to comply. They are not required to allow him to continue this action just because it is not in violation of state law. |
