my husbands name is not on his daughter birth certificate, can the mother still collect child support? becuase they are making him pay in michigan and he isnt list on the cert.

ok thanks, he knows hes the father but has not been able to see the child the mother isnt following visitation order!

Generally, if a married woman has a child, her husband is presumptively the father of the wife's child. TO not be legally, you would need to establish this in a paternity proceeding. However, if there is a parent-child bond and the court deems it in the best interest of the child for it to continue, some judges will order you to remain the father and be liable for child support.

My husband and I have been together since my step son was 8 months old.. and he has just turned 18 as of 9/22 .. His ex insistes that even though their divorce papers states ....support to be paid in the sum of $40 per week until birth of said child and then will increase thereafter to $60 per week until said child turns 18, marries, becomes self supporting, or dies...that my husband has to continue paying child support until he graduates in May06... she has not been a very understanding person and one that does not believe in reason.. Over the years she has made our life H---... There were times that our children together have had to do without just so she had her child support when it was convieniant to her.. We have not always been able to keep things current but we have always rectified the owed amounts when we were able ... we even sold our home of 7 years and our vehicles and moved in with my family took jobs with my mother and my husband with my father so a vehicle was not as important so that we were able to keep the support current and to be able to provide a better life for our own children.. My step -son is in Georgia and we are in Alabama... The divorce was in Georgia 1987 as well ...my question is does the divorce degree mean any thing and can she take him back to court to make him pay until May... He is current on all $ and his garnishment stopped 9/22 on his sons 18th birthday!!!! Help!!
