Default How have the BK laws changed? Colorado

After many years of horrible credit (simply because I never made enough money to sustain the debts after my divorce), I'm now on the road to recovery and am trying to assess my situation and weigh my options.

How have BK laws changed? I'm contemplating filing because of the numerous judgements and collections I have, totaling about $15,000, plus another $18,000 on a 2nd mortgage for a house that was foreclosed on.

Also, can I file seperately from my husband? Or are we required to file together?

One change is that there is a means test to determine your annual income, which tells you if you quality for file Ch. 7, Ch 13. Another is mandatory credit counseling prior to filing. The list of changes if quite extensive.

All depends if the assets are jointly owned by the two of you or just you. If jointly owned, both would file.

Speak to a qualified bankruptcy attorney regarding your situation. Only he/she will be able to best determine a plan of action.

    Best wishes...
My opinions are just that and are not to be taken as legal advice.
