    Default What are the laws for Maternity leave in AZ? Arizona

    I am currently 5 months pregnant and have been employed with this company for 1 year. What rights do I have? Oh yea they jus let go of about 50, if not more, employees due to the economy slowing down. They wil also be closing 16/100 dealerships. Is my job secure? Will I be able to come back after I take my leave?

    Being pregnant only protects you from being laid off BECAUSE you are pregnant. It does not protect you from a layoff that would have occurred regardless of your pregnancy.

    While they cannot select you for layoff because of your pregnancy, if you would have been laid off anyway you can still be laid off in spite of being pregnant. If your dealership is closed, you have exactly the same rights of transfer as any other employee; no more, no less.

    The Pregnancy Discrimination Act requires that you be treated exactly the same as if you were not pregnant.

    If you qualify for FMLA, you have 12 weeks of unpd. job protected leave & they have to return you to your same position or an equal one. However, they can terminate you/lay you off while on FMLA leave if they would have taken the same action had you not been on FMLA leave.

    If FMLA doesn't apply, then just the PDA cbg noted will apply.

    FMLA requires that you have worked for your employer at least a year, worked at least 1,250 hrs. in the past 12 mos., & your employer has 50 or more employees within a 75-mile radius.
