Child support expires in Texas, custodial parent files in New York

The parties were divorced in Texas in 1995 and had a child support order through Texas.

This past year, the Texas Court terminates the child support order since he reached 18 years old.

Mother now refiles in NY (since child has been going to school and now college in New York).

Does the Texas order have any bearing on the New York petition?

How long have the mother and child been residents of NY?

It's rare that NY will take this up even though they support children until 21 because it is past the 18th birthday of the child.

They have been residents since 1996.

She had over 10 years to change the support order to NY and chose not to do so, I would think it absurd if they setup an order there now.

I lived in NY up until 2 years ago however and I can certainly say, that some really absurd things get through their courts though.

Defenitely point out that you had the past order in place and you are no longer required to support this adult over the age of 18 as per that order and that the mother had more than enough time to change the order to her current resident state before the child became an adult.
