Default Retailation, publication, and slander Utah

I worked for a trucking company in Salt Lake City Utah. When I put in my application Anna the recruiter I talked to said that since I had 3 1/2 years experiance but have not drove in 5 years they would put me through a 7 day driver referesher course and start me off at .36 cents a mile. When I got to my training site after 2 days they said I would have to go to their full trucking school but they said they would not charge me anything. Well at their school I was made to sit out of class at times because I already knew how to drive a truck and I was told by david I was wasting the other students time by being in the truck. Well they then told me I needed a trainer for 3 weeks. My trainer released me after two weeks but could of released me after one he just wanted to cover his reat. After that they told me you need to be a second seat for 3 weeks at 10 cents a mile. My first seat driver john called in and said hey this guy don,t need any training he is good to go but they made me stay 3 weeks anyway. When I finally got my own truck I was told we put you thru school we are not going to pay you 34 cents a mile we are going to pay you 26 cents a mile. So at .26 cents a mile I was loosing 100 to three hundred dollars a week depending on how many miles I got that week. I called in to recruiting and talked to anna and told her at 26 cents a mile I would be turning in my truck sooner or later. Well I found out from my dispatcher I was terminated but I was 1500 miles from the yard so I called into anna and said hey im not quiting now but sometime soon im going to look for another job and when I get by the yard then I quit. She un-terminated me and I was driving again. I tried to save my job by calling in and talking to anna's supervisors. I talked to Debbie. I tried to tell here that is was not good to start a driver off with 3 1/2 years experiance at beginners pay and have him hired away. Well she got mad and we had a few civil candid words for each other. I was just trying to get a raise. Debbie told me we are not going to put you through school for free and pay you 34 cents a mile. A few weeks later when I was near salt lake I turned my truck in at the yard and went home. We I got my next driving job at (another company) they called(my former employer) for a job reference. They told them they fired me that was a lie, they told them I was late with my loads. That was a lie too the only time I was late was when the highway freezed over into a sold sheet of ice and other times it was just plain just down closed. And one time the shipper overloaded my truck to heavy so instead of paying a thousand dollar fine I stayed over 24 hours to have it loaded correctly that was not my fault. They read what I said to debbie and to my driver manger but I said nothing that was not true. I was getting paid every two or three weeks and going for days at a time without eating because they were not giving me miles and paying me for my loads until two or three weeks later and I let my driver manager know about it too. Also the first couple of months I did not get home to see my family but their policy is a driver gets home every three weeks. I lost well over 20 pounds starving because they told me I would make money with them and I ended up over two months behind in my bills at home and I have a family of three a wife one girl infant and a 8 year old daught I had to feed. Now theyare trying to prevent me from working. If any one knows of anything I can do about this please let me know. Thanks, Lloyd

Calling your employer and telling them you plan to resign in the near future is resigning. They could very well accept your termination then and there, and call it a termination.

It also isn't illegal for them to tell the reference that you were late with your loads because you were. It may not have been your fault every time but you were late multiple times and that is the truth. In the future I'd explain these situations to your employer up front so it isn't a surprise when they do the reference check.

If you weren't being paid at least semi-monthly and within 10 days of the end of the pay period for your wages (expenses aren't subject to the same timeline requirements) you would file a claim with the state DOL http://le.utah.gov/~code/TITLE34/htm/34_09004.htm
