Angry Help I need to know.....Unemployment Alabama




I went to work on Mon. morning & was terminated on the spot, my supervisor from the Atlanta office had been there over the weekend & went thru my computer, she found my resume. ( reason for it being there was I was doing one for a friend & was using it as a guide) & yes I was doing it on my lunch break. It had never been a problem for us to do stuff like this before, so I knew she was just looking for a reason to fire me, because me & my friend (who also works there), had gotten into a "spatt" & the supervisor had taken sides...HERS... I tried to talk to her & tell her why it was on there & even asked if she could give me a warning or some other kind of punishment instead of temination. The answer was "no". I filed for my unemployment & I just got a letter stating they had answered the claim, & she put the reason for termination was "refusal of a drug screen" My question is.. why would she do this? the only reason I can think of is to make sure I don't get the unemployment. A drug screen was never brought up that day. Is this legal for her to do this? What can I do? I have no witness. The only other person that was there when I got fired was a girl from the Atlanta office she had brought with her, & I know she could get this girl to say whatever she tells her to say. I'm stuck. I'm calling the UC office 1st thing in the morning so if anybody can help me out on this one, quickly I would appreciate it.

How would we know why that reason was put down? DID you refuse a drug screen...ever? Has there been an intial determination regarding your benefits? Have you already appealed? Are you talking about a telephone hearing regarding your appeal?

No a drug screen was never brought up. I would have not refused one if that had been asked of me. I called the UC call center today to talk to the rep that sent me the letter & he was not in, so I am still waiting on his call back. I don't understand how they could say I was fired for one reason to my face & then when I filed for unemployment it was a totally different reason, they reported to the UC. One that is a COMPLETE lie because I never refused a drug screen. I'm just bumfuzzled over the whole ordeal & don't know what to do. Any suggestions?

I'm just wondering if anybody else has been terminated for one reason & then when it came time to draw unemployment, the employer put something totally different than what was told to you... I know you don't know why she did it. I was just wondering if employers do this for a reason (like to prevent you from getting unemployment) & if it is legal for them to do this.

I also cannot provide insight as to why your former employer listed one reason vs. another. However it would be a lawful termination to terminate you for having your resume on your work PC. I doubt this would be a disqualifying reason for purposes of unemployment; but the termination in itself would be lawful. I fully understand that the reason provided sounds suspect. If benefits are denied, you always have an option to appeal. Good luck!
