I'm trying to determine whether a Utah employee should be catagorized as exempt or non exempt. Can someone tell me what the requirements would be?

WAY too broad a question. You'll need to give us some clues as to what the employee's job duties are; there is more than one exempt qualification.

He is a building inspector. He gathers data at assigned construction projects and documents builders compliance on residential and commercial construction. This position is a non exempt position, but he was mistakenly classified as exempt when he started 2 years ago. He works 40 hours a week and keeps track of and has to turn in a timesheet every week and has signed off on paperwork saying that he is non exempt from when he started. How can we go about changing his status from the exempt to non exempt?

You start paying him as non-exempt.
You don't need to go through any formal process. There are no forms that need to be signed or notification process to be gone through. If he is not being paid overtime when he works over 40 hours a week, start paying it. That's all you need to do. |
