I injured my back at work and was out of work for approx. 12 weeks. At time of injury I was salaried employee based on 44 hrs a week. I returned to work 20-25 hours a week with restrictions on lifting, bending, standing, etc. The company prorated my salary and gave me a hourly wage so I only get paid for the time I work. I know the all this is legal but this is my question- I am a retail store manager, when I returned to work part time none of my duties and responsibilities were reduced. Can they pay me less money and still expect me to meet the same standerds as I had to meet as a full time employee? I just can't beleive that they can cut my pay in half and still expect the same results in my preformance as when I was healthy without making any accomodations.

Yes, they can. No law governs what duties you can be assigned.

I did not want to address this without someone like you leading. However, it appears to me the employer will still be on the hook for the balance of wages in indemnity, so Mike will get paid his hours of work PLUS some indemnity and the employer's mod will still be impacted.
