Minnesota, Big Question About My Gf And Son.

Ok here's the story, Ive been dating my gf for 4 year's now, and this year she is 16 and we have a baby togather, and im 20 year's old, Ive been getting told when she turn's 17 she can move in with me, and we have a son aswell? half say yes and half say's no? it get's really confusing, we hug, kiss, and stuff and Child support said we could, State said we could? but i'm really not sure, if they are right or not, i'm trying to make sure though, her real dad live's in michegon < spelt wrong sorry, and she live's with her mom and step dad now, *And She Is Really Tired Of Her Step Dad and the way he is treating her* and speically my son we have, her step dad yell's at her everyday over stupid stuff, and her mom too when she is crabby, And i hate to see it, Im trying to be there for her and our son, I have a job and try to support them, but her mom and step dad keep using stuff agains't me, which is not fair, State said I can't go to jail either along with child support, they saw me with me and my gf's son, they said I was a really great father and bf, but her mom and step dad call me a loser, immature, f*** loser and more, and me and my gf take parent class's. Please help me, I don't want her to get stressed when she is breast feeding and going to school, it's too much on her, and they won't even let me see her now, or talk to her, which is bull.. Please help me, i really love her she will be 17 in 9 month's. can she move with me?

The age of consent in Minnesota is 16. This means that it is not against the law for the two of you to engage in sexual activity with one another.

Since she is still a minor under the age of 18, she must do as her parents say. Having a baby doesn't make her an adult, and she will not be able to move in with you when she turns 17 either (unless her parents allow it). I'm sure having a 17 year old daughter with a baby in the house is as stressful on her parents as it is on her, trying to care for a baby and attend school at the same time. Yelling at your children is not against the law.


Did she become pregnant after she turned 16, and did you engage in any sexual activities with her before she was 16 and after you were 18? If she became pregnant before she turned 16, then her parents could actually still bring charges against you for statutory rape (and any other charges that may apply in your state). Given that she is also still a minor, they do not have to allow you to see her. IF you have court ordered visitation then they must allow you to see your child, but you have no rights to see HER. Her parents could also put a restraining order against you so that you absolutely cannot contact her under any circumstance.

Unless the baby is a newborn and born 6 months premature, according to the poster's 17 in 9 months comment, I would say she was younger than 16.

she is 16 1/2 year's old almost 17, not if her step dad force's her todo stuff, *Child Abuse* when you grab her and force her to change, take a shower and etc, and he is like 33 year's old, and her mom said she wanted the baby at her house only, she can take care of our son like a real mom can, yet her mother yell's everyday, threaten's, and her step dad threaten's to kick my gf and son out on the street and etc, but why would *child support* and *the state* say that she can move out when she turn's 17? I don't get it, they called me, and i called them and talked to them, that's when they said it.

They canno't put me in jail, The State said so, it's her mom's fault, even though my gf call's me the restraing order is either closed or they get in trouble, and her mom said when I get a better job, and apartment house, she can move in with me, she got pregnant at the age of 15 and had him when she turned 16, we still need to talk over the phone child support said, cause *We do have a son* and I used to be a paramedic, and i do have friend's that are cop's, lawyer's and etc, so yeah the only thing they can do is put on restraining order on me, but it woulden't work cause my gf will call me when she can, Yet her mom won't sign the child support paper's *Against the law* i know alot, but not enough or all.

And *The State* sent me and tishina paper's to take parent class's togather with our son, and I used to live with my gf when we first had the baby, and her mom let us sleep togather, be alone and etc. So there fore her momw ould be the one in trouble, and ive told child support and state about it, and they agreed with me.

With a child? it's not a child dude, called my gf, and all i did was make a thread under minnesota laws, where it should be, so how is it in the wrong forum?

15 years old IS a child. And this is Minnesota LABOR Laws as in laws relating to working rather than birth labor.

At the time you impregnated her, she was UNDERAGE to consent to sex in your state. A 16 year old is still a child in the eyes of the law. Her parents cannot give you permission to break the law, and having sex with someone under the age of consent is against the law. Regardless of what anyone has told you, a JUDGE can put you in jail for that crime if charges were filed against you. Her parents can put a restraining order against you. I don't know who is giving you this other advice, but they need to familiarize themselves with the law as it pertains to adults who have sex with minors.
