my husband works for a call center in Alb., NM. today, Labor Day (of all days), he was scheduled to work from 2-11 pm since he is still new and low man on the totem pole. his usual shift is from 6:30 am to 3:30 pm, and he returns to it bright and early tomorrow morning. this means that tonight he will get a 7 1/2 hour break between shifts. i was under the impression that there was a minimum amount of time that an employer had to wait in scheduling employee shifts, and i'm pretty sure the figure i remember is not less than 8 hours. does the law have any recourse for this situation?

Pattymd is absolutely correct on this.
I can tell you from experience that call centers have high turnover. The last time I checked, the national average was greater than 30%. I'm sure your husband will gain seniority quickly and taking holiday shifts will switch to the "newbies". I suppose this is just a form of paying your dues at the company. |

As with most situations in New Mexico everything seems to favor the employer. I am just posting my disgust that they can get away with such inconsiderate scheduling. That is why unions are very badly needed across the board in all industries in New Mexico, because their are few laws, broken laws, and workers are kept ignorant of their rights!
