I know that you cannot get the following credit:
Earned Income Credit
Child Tax Credit
Additonal Child Tax Credit
And I belive if your spouse itemized you have to also which can be bad if you don't own a home
Just a suggestion if you don't want to file with him because he owes money to irs or someone else file a Injured spouse for that way you can get your portion of the refund.

A married couple is known as to be a single entity. The IRS thinks this is the case also. That said, once a couple has gotten married they must decide whether to file individually or together.
