    Default service of process-national bank

    How do I serve process on a national bank, i.e. NA? I am in Florida
    where the bank has many branches. They are not registered with the Division
    of Corporations. Thank you.

    I am not a lawyer, and I've been to Small Claims Court twice in my life
    (one lost, one settled).

    Usually, the biggest problem in suing a business seems to be in getting
    their name right. I think what I would do is look around the branch
    for any sort of business licenses or permits, and use the name I see on
    those permits.

    BUT, if this potential lawsuit involves you as a customer or client of
    the bank, is it possible that you signed an "agreement" where disputes
    must go to binding arbitration?

    They should have a "registered agent" somewhere. Depending on state,
    there may be a "banking commission" that covers those banks. This is
    the case in Oregon. You may try starting at http://www.flofr.com/
    though I don't know if this is the right place.

    If you can't find an alternate in the phone book, try calling and
    talking to a human at the secretary of state's office or at the
    Corporation Division.
