A friend (Illinois) is having a dispute with Herz Rental Services. Herz
believes the friend owes them money ($10,000, incident-related). He thinks
he does not. He informed them in writing about his opinion, suggesting they
sue him and the court decides who is right.
Herz don't sue him, but instead hire collection agencies. The frient already
had been contacted by two; he sent the prior correspondence with Herz to the
first one, and they stopped their activities. Obviously, now Herz found
another agency, a law firm, so it's all over again.
Is there a way to stop Herz from hiring agents for collecting the debt they
know is disputed? Is there any violation in the practices of referring
disputed debt to a 3rd party collector? Is there a way to discourage Herz
from future collection efforts besides the lawsuit?
