If someone makes a false report against parents of children and the investigation shows that the report had no merit, would the parents have any recourse against the person who made the false report? The social worker will not divulge who made the report. Ora (California)
I believe it's usually a crime to knowingly or recklessly make a falsereport of child abuse. Here's a site re false reporting in CA:12. What will happen to me if I make a report?Anyone who reports known or suspected child abuse is protected by law fromcivil or criminal liability unless it can be proven that the report wasfalse and that the person who made the report knew it was false. Any person, except a mandated reporter who reports child abuse may remain anonymous.Mandated reporters are required to give their names. However, it is helpfulto give your name and telephone number to the worker taking the report inthe event he or she needs to obtain more information later.
