    Default Family member not paying rent eviction question

    I'm not involved, just curious as to what rules apply in this situation:

    A woman in her 40's is living with her mother rent free. Her mother becomes
    incompendant<sp?> and her eldest daughter is made her keeper. The eldest
    daughter has given the woman (her sister) 15 days notice to leave the home
    so eldest daughter can sell the property. If the woman isn't paying rent,
    is the eviction process in order here? If not, what key terms should be
    researched? This is Pennsylvania. Also, if it matters, the woman is
    disabled and on SSI.

    Jane,

    The process of eviction usually takes several months. The necessary steps
    depend on the local laws. The best way to do this is to buy an hour or two
    of an attorney's time and learn what needs to be done locally. Your fifteen
    day notice is likely to be quite unenforceable.
    The elder sister needs to think about the consequences of evicting her
    own family in the middle of Winter. It might be better to help the relative
    to get some help in locating an inexpensive apartment and help her move
    rather than evict.
    It really sounds as if these sisters have long standing problems.

    Consider paying the reluctant tenant a couple of thousand to leave. That
    might get some action. And in the long run it could be cheaper than letting
    the place sit while going through a long eviction process. Think of the
    payment as just another expense in selling the house. After all, you will be
    paying a real estate agent a lot more to get the house sold.

    Something else to consider is, does this person have power of attorney?
    In order to sell the house, that may be necessary, as well as for the
    eviction.
    The one can not simply evict the other without some legal authority backing
    them up.
    Without POA, I doubt if the sale could take place.

    Thank you to all who answered.

    You all had good points for the family to consider. Yes, I believe the
    elder daughter does have POA, but not sure. The real estate agent isn't
    going to make much on this deal anyway. The house is located in depressed
    area and is in desparate need of repair... such as a roof, wiring, you name
    it. Yes, there have been LOTS of issues in this family. This incident is
    just the tip of the iceberg. Thank goodness I'm not related!!! I doubt the
    elder sister would consider paying the woman to leave, that would be against
    her motive to make the woman's life more miserable than it already is.
