Default Vacation Pay????

I was told that I have 40 hours vacation pay that I have earned. I requested my 40 hours vacation pay, in a week that I worked 16hrs. I was informed that I could only be paid my vacation pay for hours that I was scheduled to work that week. I am not ordinarily scheduled 5 days a week. Sometimes 3 days sometimes 4 days. I am of the understanding that vacation pay is earned paid days off and does not require me to be "scheduled" to work any specific day. My question is can I (or not) collect 40 hours of vacation pay in a week when I was scheduled to work only 2 days????

It is perfectly legal and common for an employer to only allow paid vacation to the extent you actually missed a day of work. In effect, what you were asking for was a cash out of your (remaining) vacation days in that week, and very few employers' policies allow that.
