My store got robbed Nov. 2nd 2009, at 3am in the morning, being a main shift lead, I go to the store to help out, the Manager and Assistant arrive shortly after, and we stay there til 6am, and reopned the store.
When i came back to work at 3pm, that day I was curious if the manager was considerate enough to clock me in for my work, from 3am to 6am, and he didn't, well I look back and notice on Nov 1st, my time punches had been changed... 2 Lunches were added in on the 31st and the 1st, and an hour cut off on the 1st, to drop me down to 39.52 hours, so I wouldn't get overtime, and it was changed at 7:29am Nov2nd, shortly after the robbery so I, pulled the video tapes, and watched to see who it was and it shows my manager. I call the district manager, and ethics and report it, as of now it has been stated that, the Store Manager is unsuspended, and coming back, due to I made the false claim, due to disliking him.. So now i'm counting down the days til I Get fired, I'm grabbing the security tape and the print out, and going to make sure, I keep the proof safe, I already changed the safe combo for the side its on, the day it happened so he couldn't grab it. But last i checked, time punch changes is illegal, and i really honestly don't think he should be coming back, because this just screams employee retaliation all over it! He has been with the company 11 years, and my store for 6 months, and wouldn't let me transfer out, and denied me every time, stating the store needs me. So i endure a 30 mile commute one way everyday, to deal with him. He has already told me once that he does not need a reason to fire me. So i guess im basically asking it is illegal to change my time punches right?! The company has a paper they want the employees to sign stating they been paid correctly for the past few pay periods. |

The law on time accounting is on the employers, not the employees. So changing time accounting per se is not illegal. What is illegal is not paying non-exempt employees based on actual hours worked. You can file a wage claim with the OR department of labor, which I think is called something like BOLI.
It is possible for employees to simply maintain their own time accounting records at home. A paper notebook and pen work fine. Regarding the piece of paper they want you to sign, do not sign it.

Changing the safe combination and not giving it to your mgr is not wise since it would be a valid reason to term you.
Also if you retain the security tape it may be viewed as theft. |
