Default Baby Boomer Question

Hello everyone....
I hope someone could help and send us in the right direction but Im a memeber of the Canadian Union of Public Employees and I have searched the web for a form like this for Canadians but still havent found one yet!!!

My question is -
We have an employee who had applied for a job and didnt get the job because he "didnt" answer the interview questions well..... This person had done the job and held it for 20 years, moved out of that position for a few years now wanted to go back... he didnt interview well and the person that did get the job was a new to the company fresh out of school, Im wondering if there are any "wins" based on the person being older and hadnt done an interview for over 20 yrs, he is a baby boomer and im hoping to use that as reason why the interview didnt go well because he hadnt had one in years and the "new" younger person are trained in school now how to interview ???

Any idea's????

Have you talked to the union rep?

This is a US law forum & I'm not sure anyone will be able to answer your question.

yes, we are taking it to arbitration i was just looking for other simular cases! I cant find a canadian forum so just wanted to post it to see if maybe someone else has had the same fight?

You "probably" won't get an answer here but you're welcome to check back. It should be handled through your union as it seems to be.

The problem is that Canadian law and US law are not the same.
