Fiancee Visa vs. Marriage and Immigrate
Hi:
I am trying to figure out which is the easiest way to get my girlfriend in Viet Nam over here as my wife. Do we do the fiancee visa and all the work involved, or is it easier for me to either marry her in Viet Nam, or have her come here on a tourist visa and marry her in the US, then when she goes back home, apply for an immigration visa at the US Consulate in her country? Can anyone tell me which requires less headaches, time, $$, and hassle, based on all the options. Any help is greatly appreciated. Pls. Advise and thanks in advance. CW |

Which service center has jurisdiction over your place of residence? DCF for non residents is not available for Vietnam and as money seems to be one of your key criteria I would assume that you may choose the Fiancee route. However, unless you live in the Vermont Jurisdiction you may want to consider other options...such as marriage in a third country. You need to consult an attorney. I would marry in her country, meet her family, see her homeland, and then do a K-3. There are a lot of factors and questions to be considered though and you don't come close to giving enough detail for anyone: including a lawyer, to give an educated answer. As example, maybe her father was an american soldier... You are going to have headaches, time , and hassles no matter which route you take. Prepare yourself and Good Luck! First of all, the "come here on tourist visa and marry her in the US" has been given the nickname of "ten foot pole" on this NG. The only comment I will make at this point is that that scenario happens to be illegal and the potential adverse consequnces are extremely severe including and up to criminal prosecution for both of you and a lifetime bar from her entry to the United States. As to the lawful means, you don't bother to prioritize your goals -- what is most important? Speed, hassle or $$? Also, there may be other factors in your case that prevent a cogent answer. Good luck. -- Certified Specialist Immigration & Nat. Law Cal. Bar Board of Legal Specialization Posted via http://britishexpats.com |

Fianc=?ISO-8859-1?B?6Q==?=e Visa vs. Marriage and Immigrate -K1 vs. K3?
I am in California. I will consider the marriage there. Where can I find
more info on that? I have met her family and visited 2x, with the third time next month during holidays. Her Father is Vietnamese. It seems the K1 is less hassle and paperwork and time vs. the K3? Can anyone else fill me in, since this is all new to me.
