    my relative passed away without a will. He had a life insurance policy that had no beneficiary listed. The company that he worked for used ERSA rules and paid the money to my grandfather. According to state probate law this money should have went into probate. From what I have read my grandfather should have taken the money to the probate lawyer. Should we be seeing my grandfather?

    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
