  • Applied for PR in Nov 02 - Getting married in Feb 04

    Hi,

I have applied for the Aussie PR in Nov 02 from India. Recently I have
received a request for Medicals and PCC to be forwarded to them by the
    end of November 2003.

I have a question to ask:--

I am getting married to a girl in Feburary 2004....mine is arranged
marriage as there is no formal engagement or love affair as such..as a
norm in India. Now I do not have any definitive evidence of my
engagement to this girl and marriage registration certificate would be
made only after marriage in Feb 2004.

Am I supposed to tell the ASPC about my intending marriage...if so
what is the procedure ? Since it seems my application is in the last
stage of decision making, I do not know what to do. I am not expecting
the decision before Feb 2004 and I wish to include my fiancee in my
application. But I do not know how to do it.....i have no evidence in
this regard.....no photographs or agreement as such..she does not even
    have a passport!

I shall be very grateful to you if someone throw some light on the
    above matter.

    Thanks a lot

    Rajiv

    Hi Rajiv,

Due to recent changes in the administration of offshore visa applications
and the interpretation of the phrase "Australian permanent resident" in the
Migration Regulations it is quite important that you advise DIMIA of this
impending marriage, and then make the following choice: you can decide to
migrate to Australia and then sponsor your wife after you are married, or
you can ask for your own visa grant to be delayed so that she may be
included in the application. If you do decide to come here first and then
sponsor her, you will need to be here in Australia while she waits for the
    visa to be granted.

    Cheers

First of all, get your would-be-wife to apply for a passport. And as
George said, inform DIMIA about your impending marriage. It would be a
good idea to ask for a delay in your visa grant so that your wife can be
included in your application. Of course you would need to submit all
relevant documenation to DIMIA in due course as you get the documents
(marriage certificate, photographs, wife's passport copy etc).

And in case this doesn't work out and you see that you will have to
leave for australia alone and then apply for her visa, tell this to your
would-be-wife now to avoid a brawl later.

      Cheers,
