  • Nebraska real estate partition petition

    Hi,

if a farm is held between several owners in undivided shares in nebraska and one of the owner's can demonstrate financial hardship, how likely is it that this owner can force a partition or sale?

thanks very much for any insight on this. sumeru

A co-owner doesn't need to demonstrate financial hardship to force a partition sale. He normally just needs to tell the court that he/she wants out of the ownership arrangement and has not been able to reach an agreement with his fellow owners.
I am not able to respond to private messages. Thanks!
