I-130 processing times (Boston + NBC-Missouri)

  • I-130 processing times (Boston + NBC-Missouri)


    We filed our concurrent I-130/I-485/I-765 on July 21, 2004 at Boston.
    Recieved NOA on all three from NBC-Missouri with a date of July 28,
    2004. I am a US Citizen and am hoping that since there is no limit on
    visa numbers for spouses of citizens that this will not take *too long*.


    A check on the NBC processing dates shows they are currently on Nov.
    2001, which seems horrible. This was confirmed to me on the phone on
    the national customer service 1-800 number.

    Is there anyone that has
    seen better processing times with the NBC of late?

    Also, there is a
    link on the uscis.gov web site about "Notice To Customers With a Pending
    I-130 Petition" (]http://uscis.gov/graphics/publicaffairs/newsrels/-
    I_130_07_01_04.pdf[/url]), there is a statement that says - "If you are
    a US Citizen..... USCIS will adjudicate your Form I-130 prior to visa
    availability (or within six months if a visa is immediately available
    upon filing)."

    I-130 processing times (Boston + NBC-Missouri)


    NBC is not processing your I-130/I-485. They only do the initial
    footwork, i.e. sending you NOA, notification to go for biometrics,
    etc. When Boston is ready to adjudicate your case they will get the
    file back from the NBC and you will be notified of your appointment.
    Boston historically takes about 6 to 8 months.

      For the Record, at
      least 1/2 of us are US citizens. And there is no limit on visa numbers
      for spouses of US citizens. Why would you think there was.

      As for
      taking too long, why is that a problem? It could take four years and
      still your spouse will be living with you and working and enjoying
      married life. Unlike those people who are only PR's and have to live
      with a visa quota system and go to bed alone each night for 5 to 7
      years.

        Thanks for the response. If NBC
        does not process I-130/I-485 then is there a reason why they have I-130
        processing dates status on their web page? They don't have one for I-
        485's.

          I think I mentioned that there is no limit
          for spouses of US citizens - sorry if I was unclear.

          My main question
          was about the processing date of Nov 2001 for I-130's for the NBC -
          which is bizzare/horrible/bad - and I hope it is not true.

            They don't have one for I-485 because they
            DO NOT adjudicate them. It is your local office responsability, when
            looking at the processing times.. you must look the ones at your local
            office
            Same thing with the I-130's

                The pertinent section
                from this post states:

                "The Yates Match Memo advises local USCIS
                offices and the National Benefits Center to request the pending I-130
                petition from the Service Center whenever the local District Office
                receives any I-485 based on that I-130 petition filing. The Service
                Centers must locate and send the petition to the requesting local
                District Office via FedEx within 15 days of receiving any such request.
                The Service Center is not required to adjudicate the case within the 15
                days, so most I-130s will likely remain unadjudicated when they arrive
                at the local offices. A final decision on both forms would then be
                reached in most cases on the date of the interview at the local USCIS
                District Office. "
