  • TN: exempt salary-pay or day, for 30 straight?

    Whats the Tenn labor Law for Salary, exempt or hourly employees working 7, 14, 21, 28 or 30-60-90 days straight with no compensation for a day off or pay?

    Also, working 8-10 hours per day for 30 days straight, with no day or pay?

    Or, working 60 hours per week for 4-5 weeks straight with no compensation in pay or day off? All situations are exempt salary.

    Or Hourly Employees being forced to work weekends, 30 or more days straight--being paid, but tired and not wanting to work but can't take off (cause its mandatory), or can't call work to be off, cause they'll be wrote up for it?

    In all 50 states, regardless of how many hours they work, an exempt employee is not entitled to any compensation over and above their regular salary. If an employer wishes to provide them with a bonus, additional pay, or comp time, that's fine, but an exempt employee has no legal expectation of anything but their regular salary under any circumstances unless they have a bona fide, enforceable contract that says otherwise.

    Nothing in either Federal or Tennessee law would prohibit an employer from requiring an employee to work 365 days a year. Both Federal and state law require that a non-exempt (read hourly) employee has to be paid OT for any hours after 40 in a week, but neither limits how many hours an employee can be required to work in a day or how many days in a row the employee can be required to work.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
