    My wife and I agree on a divorce under grounds of adultery (her). We are filing a petition for divorce ourselves, not using an attorney. We have been in mutually agreement on this during our near 3 year separation. Being in the position to now move forward with the divorce, we have a question.

    The adultery is the cause which will end our 18 year marriage which also caused our separation (not legally). Soon after the act, she admitted what happened which was also captured on voice recordings.

    Without wanting to explain our situation and reasons for not going with cruel and Inhuman Treatment instead of Adultery and reading the vast internet articles on adultery not being used, will the Court challenge or possibly deny our divorce? Would it be processed without an appearance? Neither of us are opposing any aspect of the grounds or settlement agreement?

    I realize this may be unusual in nature, but this is how we would like to proceed.
