    My husband and I live in the state of Minnesota I had a baby Jan 1, 2006 because my husband had used all his FMLA time in 2005 he did not qualify for it again until February 2006 - H.R. suggested he use his Paternity leave as long as he used it all at once he was allowed 6 weeks but only used one day. Now H.R. is saying that he has potentially used all his FMLA time for the year even though he did not legally qualify for an FMLA at the time the Paternity leave was used. In the state of Minnesota is Paternity leave the same as FMLA?

    In all 50 states, paternity leave is part of FMLA, The employer may choose to offer additional time if they so desire, but FMLA specifically includes both maternity and paternity leave.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
