    question for a friend

    my friends boyfriend just left her and their 21 month-old daughter and moved out; he never signed the birth certificate at the hospital but always claimed her as his; now he says he wants a DNA test before he pays child support, but says he will give his ex girlfriend $300 for bills, which he has this month already by check so he has proof he paid her. is this money considered a gift or will it be considered child support after he takes the DNA test and starts having court ordered child support deducted from his pay?

    If the dna proves he is the father then yes, he will have to pay. If it proves he is not the father then your friend will have to pay for it.

    yes she is going to file for paternity and CS because she gets help from the state, and he paid with a check and told her it would go towards child support after he takes a test and starts paying. Will he have to pay for the test since he's the one who wants it?

    Is your friend planning to file for paternity and CS? The court will order a DNA test done before they will order CS. Any money he gives her before the order is issued can be either a "gift" or the court can also give him credit for the payments towards any retro support ordered. Most of it will depend on the Judge and whether or not her BF is smart enough to bring the cancelled checks to court and ask for credit.
