    The company I work for is located in IL however our corporate office for payroll and HR are in IN. We have numerous employees who are Non exempt salaried employees. They still clock hours worked and still receive overtime. The way they are to be paid is changing this year to bi monthly instead of every two weeks. They are stating that the Non exempt people will recieve 86.67 hours per pay period plus any adjustments for overtime, holiday, sick, and vacation time. Is it legal for the hours to be paid as though the person were salaried (exempt) averaged out to the 86.67 hours per pay period even though they are non exempt (what I consider to be an hourly employee)?

    Yes, it is legal, as long as the people are receiving the appropriate amount of overtime.
