    Our last pay period at work was 12-27-2012 through 1-7-2013. Social security tax has gone up from 4.2% to 6.2%. My employer taxed the entire check at 6.2%. Is it legal for them to tax the days worked in 2012 at the higher rate because the pay period ends in 2013?

    It is not only legal, it is required. Which rate is used is dependent on when the paycheck is issued, not on when the days were worked.
    The above answer, whatever it is, assumes that no legally binding and enforceable contract or CBA says otherwise. If it does, then the terms of the contract or CBA apply.
