    We get paid bi weekly. One wk 36 one week 48. Minus 30 min for lunch. Which is 84 in 2 weeks. Is it legal not to give us the 8 hr ot in our long week?

    Probably illegal. However the federal FLSA law has a fairly huge number of exceptions, some of them pretty obscure.
    - What are your job duties?

    - Do you work for an employer who can be considered governmental in nature?

      The company is a bakery of bread and muffins. I don't think it has anything to do with the goverment.

        There is nothing in the industry that would get around the 40 hour in the workweek rule.

          Would we be in-tiled to back pay for all the weeks we worked like this? And who do I contact to let them know that this is how we are being paid?
