Server wage and breaks in iowa Iowa

was just wondering what server minimum wage is and what break requirements are even if you're a non-smoker per hours worked in the state of Iowa. I was also curious if an employer can legally force to tip out bartenders, bussers and dishwashers since they make an hourly wage. I was under the impression that tips are considered a gift in the state of Iowa and that employers could not force you to give a percentage of your tips to other co-workers....

That'll teach me to start a response, then have to actually meet a 1:30 Treasury deadline and actually have to do some work.

    You have some incorrect understanding.

    Minimum wage http://www.iowaworkforce.org/labor/minwage.pdf

Read here about tipped employees. It will answer a few more of your questions:
    http://www.dol.gov/whd/regs/compliance/whdfs15.pdf

Regarding rest periods and meal breaks, neither federal nor Iowa law requires them.

The state of Iowa does not require breaks of any kind.

BTW, in NO state does the number or length of breaks you are entitled to under the law depend upon whether you smoke or not. There is NO state that requires smoke breaks.

I can handle the tip related questions only. That is mostly federal law, and the following two factsheets will give you federal rules on tips, plus sort of a 50 state chart to the state exceptions on tip rules.

Meals/breaks can indeed be Iowa specific, and since that is not my state, I will let someone else address that question. I can say that the feds do not care if you get any breaks (ever), but do have some rules on what happen should breaks be given.
